Terms of Use

These Terms of Use ("Terms") govern your use of datadrivenmaps.com, Data Driven Maps software, and DDM-hosted services that link to these Terms. By using those services, you agree to these Terms. If you use DDM for an organization, you represent that you have authority to accept these Terms for that organization.
1. Data Driven Maps
Data Driven Maps provides WordPress software and related hosted services for turning structured data into maps, lists, search experiences, presentations, and related outputs. Features may include free software, paid software, add-ons, connectors, account services, licensing, support, and other hosted functionality.
Some products or services may have additional product-specific, licence, order, or provider terms. If additional terms conflict with these Terms for a particular product or service, the more specific terms control for that product or service.
2. Eligibility and accounts
You must be legally able to enter into a binding agreement to use DDM. If an account is required, you are responsible for providing accurate information, maintaining the confidentiality of your credentials, and for activity performed through your account or authorized site activations.
You must notify us promptly at support@datadrivenmaps.com if you believe an account, credential, licence activation, or connected-service authorization has been compromised.
3. Software licences
DDM software may include open-source components and proprietary components. Open-source components remain governed by their applicable open-source licences. Any separately distributed paid DDM package, add-on, connector, or other proprietary component is licensed, not sold, subject to the licence and entitlement associated with your purchase or account.
You may not remove or bypass technical controls intended to enforce a paid entitlement, distribute proprietary paid packages to unauthorized parties, or use a licence in excess of the site or account scope associated with it.
4. Subscriptions, prices, and payment
If you purchase a paid DDM product or service, you agree to pay the price and applicable taxes shown at the time of purchase. Recurring subscriptions renew according to the billing interval and terms shown in the applicable offer unless cancelled before renewal.
Cancellation stops future renewal but does not retroactively cancel the paid period already purchased. Unless a specific written offer says otherwise, payments are non-refundable.
Prices, product packaging, features, and availability may change prospectively. A change does not alter a completed purchase for the period already paid except where required by law or expressly stated in the applicable order terms.
5. Third-party services and connectors
DDM can interact with third-party services such as mapping providers, commerce systems, CRM platforms, field-service systems, spreadsheets, APIs, and other connected sources. Those services are provided by third parties, not DDM, and may require separate accounts, fees, credentials, permissions, or acceptance of their own terms.
You are responsible for having the right to connect and process the data you authorize DDM to access. DDM is not responsible for a third party changing, suspending, limiting, or discontinuing its API, service, terms, pricing, quotas, authentication requirements, or availability.
6. Your data and content
You retain ownership of the data, content, and configuration you provide to DDM or process through your WordPress site, subject to any rights held by third parties. You grant DDM only the rights reasonably necessary to host, transmit, process, reproduce, and otherwise handle that material to provide, secure, support, and improve the services you choose to use.
You are responsible for your data, including its accuracy, legality, permissions, retention obligations, privacy disclosures, and the consequences of publishing it through a map, list, search result, embed, or other output.
7. Acceptable use
You may not use DDM to:
- violate applicable law or the rights of another person;
- access or process data you are not authorized to use;
- introduce malware, interfere with security controls, probe for vulnerabilities without authorization, or disrupt DDM or another user's service;
- attempt to gain unauthorized access to accounts, systems, credentials, licences, or connected services;
- use the service to send spam, conduct fraud, impersonate another person, or facilitate abuse; or
- reverse engineer or circumvent proprietary paid functionality except to the extent a restriction is prohibited by applicable law or an applicable open-source licence expressly permits the activity.
8. Availability, changes, and support
We work to provide reliable software and hosted services, but no service is guaranteed to be uninterrupted or error-free. Features may depend on WordPress, hosting environments, browsers, mapping providers, APIs, third-party vendors, internet connectivity, or other systems outside DDM's control.
We may modify, replace, suspend, or discontinue features when reasonably necessary for security, compatibility, legal, operational, or product reasons. Where a material change affects a paid hosted service, we will use reasonable efforts to provide appropriate notice when practicable.
Support availability and response expectations, if any, are those stated for the applicable product or plan. No unstated service-level commitment is created by these Terms.
9. Intellectual property
Except for your content and third-party materials, DDM and its licensors retain all rights in Data Driven Maps, including its branding, proprietary software, hosted services, documentation, designs, and other materials. These Terms do not grant you rights to use DDM trademarks, logos, or branding except as needed to identify the product in ordinary use.
10. Feedback
If you voluntarily provide ideas, suggestions, or feedback about DDM, you allow us to use that feedback without restriction or payment to improve or develop DDM, provided we do not claim ownership of your confidential information merely because it was included in feedback.
11. Suspension and termination
You may stop using DDM at any time and may cancel a recurring subscription through the available account or support process. We may suspend or terminate access to hosted services when reasonably necessary because of nonpayment, security risk, abuse, a material breach of these Terms, or legal requirements.
Termination does not erase obligations that by their nature should survive, including payment obligations already incurred, ownership provisions, warranty disclaimers, limitations of liability, and terms relating to disputes.
12. Disclaimers
To the maximum extent permitted by law, DDM is provided on an "as is" and "as available" basis. We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.
DDM does not guarantee that a map, geocode, connector result, sync result, price, third-party response, or other output is complete, accurate, current, or suitable for a particular legal, safety-critical, financial, or operational decision. You are responsible for reviewing outputs appropriate to your use.
13. Limitation of liability
To the maximum extent permitted by law, DDM and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunity arising from or related to DDM.
To the maximum extent permitted by law, DDM's aggregate liability arising from or related to a paid product or service will not exceed the amount you paid DDM for that product or service during the twelve months immediately before the event giving rise to the claim. For a free service, DDM's aggregate liability will not exceed US $100. These limitations do not apply where applicable law does not allow them.
14. Indemnification
If you use DDM on behalf of a business or organization, you agree, to the extent permitted by law, to defend and indemnify DDM from third-party claims arising from your unlawful use of DDM, your content or data, your violation of another party's rights, or your material breach of these Terms.
15. Changes to these Terms
We may update these Terms as DDM evolves. Material changes will apply prospectively. We will update the effective date and, when appropriate, provide additional notice. Continuing to use the affected service after revised Terms take effect constitutes acceptance of the revised Terms to the extent permitted by law.
16. General terms
If a provision of these Terms is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent except as part of a bona fide sale or transfer of substantially all of the relevant business or assets. We may assign these Terms in connection with a reorganization, merger, acquisition, or sale of the DDM business or assets.
These Terms, together with any applicable order, licence, product-specific terms, and the Privacy Policy, form the agreement governing the relevant DDM service.
